Raee: avanti... piano

La Conferenza Unificata Stato-Regioni ha approvato il regolamento che stabilisce le procedure semplificate da parte del settore della distribuzione per garantire la raccolta e il trasporto dei Rifiuti elettrici ed elettronici (Raee). In questo modo – spiega il ministero dell'ambiente - si compie un passo ulteriore verso il definitivo avvio della raccolta differenziata e del conseguente recupero dei rifiuti hi-tech. Il Decreto (n.248) – commenta il consorzio Ecodom nella sua newsletter - disciplina la gestione dei Raee da parte dei punti vendita secondo il principio dell'uno contro l'uno. Una volta ricevuto il via libera dalla Conferenza Unificata, il Decreto dovrà passare necessariamente anche al vaglio della Commissione Europea. Uno step obbligatorio che potrà richiedere anche 90 giorni. «Fare previsioni circa la data della sua futura pubblicazione – spiega sempre Ecodom - è quindi oggi difficile anche se, visto il numero di soggetti chiamati ad esprimersi in merito, è possibile che il ritiro uno contro uno non possa concretizzarsi prima del secondo semestre 2008». Il Consorzio Ecodom segnala inoltre che il 20 marzo sempre in Conferenza Unificata Stato-Regioni è stato presentato, ricevendo parere favorevole, il Decreto che semplifica l'iter autorizzativo fino ad oggi necessario per l'apertura di un centro di raccolta dei rifiuti urbani. Anche per quanto riguarda i RAEE quindi i Comuni potranno più facilmente organizzare e gestire la raccolta, aumentando così i quantitativi avviati ad un corretto trattamento. Ora serve la firma del Ministro Pecoraro Scanio per poi essere pubblicato in Gazzetta Ufficiale (secondo gli addetti ai lavori entro le prossime elezioni amministrative). Il programma dei prossimi mesi per la normativa dei Raee – spiega ancora Ecodom - si prospetta ricco di impegni. Oltre alla stesura dei decreti ministeriali per la piena applicazione del D.Lgs 151 (ad oggi ne mancano all'appello ancora 10), è prevista anche una parziale riscrittura del 151/05: la "Legge comunitaria 2007", approvata in via definitiva lo scorso 19 febbraio, ha infatti delegato il Governo a rivedere il D.Lgs 151 in particolare per quanto riguarda l'eliminazione del concetto di "apparecchiature usate". Insomma: avanti piano, come purtroppo costante di questa travagliata storia della normativa dei Raee…

Campania: cassazione riduce somma sequestrata alla Impregilo

Accolto il ricorso della multinazionale, e delle tre società satelliti, annullando con rinvio l'ordinanza del Tribunale del Riesame di Napoli con la quale era stato disposto il maxisequestro di 750 milioni di euro nell'ambito dell'inchiesta sui rifiuti. Le sezioni unite penali della Corte di Cassazione hanno accolto il ricorso della società Impregilo, e delle tre società satelliti, annullando con rinvio l'ordinanza del Tribunale del Riesame di Napoli con la quale era stato disposto il maxisequestro di 750 milioni di euro nell'ambito dell'inchiesta sui rifiuti in Campania. Ora la questione tornerà ai giudici partenopei che dovranno stabilire l'entità della riduzione del maxisequestro. In sostanza il collegio esteso ha aderito alla tesi esposta dal Procuratore generale, Gianfranco Ciani, che aveva chiesto anch'egli un accoglimento del ricorso delle società con rinvio. La stessa Cassazione ha diffuso una massima provvisoria fornendo la soluzione all'importante quesito di diritto su quali siano le somme da sequestrare quando queste sono proventi di reato: in particolare, si legge nell'informazione numero sette, "deve intendersi per profitto del reato di cui agli articoli 19 e 53 del dlgs 231 del 2001 il vantaggio economico di diretta e immediata derivazione causale dal reato, che va determinato tenendo conto dell'utilità eventualmente conseguita in concreto dal danneggiato".

EUR 5m for municipal solid waste management in Serbia

The EBRD (European Bank for Reconstruction and Development) is lending €5 million to the Duboko Waste Management Company to build a regional solid waste landfill that will serve more than 300,000 people in nine municipalities across central and western Serbia. Inadequate solid waste treatment is one of the biggest ecological problems in the country and solid waste management has been defined as one of the priorities of Serbia's environmental policy. This project will support Serbia's national strategy of creating new regional landfills, improving solid waste collection facilities and helping to close down illegal landfills that do not comply with EU standards. The loan will specifically finance the new landfill with waste collection points, transportation trucks, and waste separation facilities used for recycling and composting. This will be the first regional municipal waste landfill in Serbia to be built in accordance to EU standards and the national solid waste strategy. The investment programme also includes landfill gas extraction and flaring, and the project has the potential to become one of the first in the solid waste disposal industry to benefit from a carbon transaction associated with landfill gas flaring. This could set the standard in the country in terms of reducing the carbon footprint from landfill operations. The project benefits from a €400,000 technical cooperation grant from the European Agency for Reconstruction for a feasibility study as well as a €3 million grant for project costs.. The Serbian government is also providing grant funding of over €1 million. The remainder of the financing for the project is coming from the nine municipalities themselves through capital contributions to the company. An additional €308,000 grant will be provided by the French government for a financial and operational performance improvement programme. Henry Russell, EBRD Deputy Director for Municipal and Environmental Infrastructure, said Serbia faces major challenges in modernising solid waste management to ensure compliance with EU standards. The successful multi-municipal collaboration should encourage other towns and cities to structure solid waste management on a commercial basis, thereby helping to establish more efficient, sustainable and ecologically sound systems throughout Serbia. This is the first Bank's project in Serbia's solid waste sector and is the first financing to a regional public utility company. Previously the EBRD has extended loans to the municipal sector through loans to the city of Belgrade, used for investments in the city-owned transport company, district heating and the water company, and loans to smaller municipalities, including Nis, Novi Sad, Kragujevac and Subotica under a sovereign guarantee.
